Guidelines to save road accident victims by Samaritans, laid down by Supreme Court of India





Supreme Court of India (Bench of Justice V. Gopala Gowda and Justice Arun Mishra) in the case of Savelife Foundation & Anr vs Union Of India & Anr in Writ Petition (Civil) No. 235 of 2012 rendered an important judgment on 30th March 2016. In this judgment, the Supreme Court issued guidelines to save life of victims of road accidents by Samaritans i.e. bystanders who are helping them. The petition was filed under Article 32 of the Constitution of India in public interest for the development of supportive legal framework to protect Samaritans ie. bystanders and passers-by who render the help to the victims of road accidents. These individuals can play significant role in order to save lives of the victims by either immediately rushing them to the hospital or providing immediate life saving first aid. Under these guidelines, it has been provided that a person who inform about a road accident victim or who brings a road accident victim to the hospital, is not bound to disclose his identity, no questions should be asked from him and he should not be harassed at all and suitable steps should be taken by the State to reward him.
